Terms of Service
Pre-launch notice. Six Pillar Financial is in closed pre-launch development. Access is gated to internal personnel and authorized testers only. These Terms are a working draft; a final, reviewed version will be published prior to general availability.
1. Agreement to terms
These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services (collectively, the "Service") provided by Six Pillar Financial, Inc. ("Six Pillar," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
Six Pillar operates a financial technology platform that offers Home Savings Plan ("HSP") accounts intended to help first-time home buyers accumulate funds for a home purchase. Deposit accounts offered through the Service are held at our sponsor bank, Austin Capital Bank SSB, Member FDIC. Six Pillar is not a bank, and Six Pillar does not hold customer deposits. Deposits at Austin Capital Bank are insured by the FDIC up to applicable limits.
3. Eligibility & account opening
To open an HSP account, you must:
- Be at least 18 years old and a U.S. resident with a valid Social Security Number or Taxpayer Identification Number.
- Provide accurate, current, and complete information.
- Successfully complete our identity verification (Know Your Customer / Customer Identification Program) process.
- Not be listed on any U.S. government sanctions, embargo, or denied-persons list.
Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. When you open an account, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver's license or other identifying documents.
4. Your account
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us promptly of any unauthorized access or use.
- You may not transfer your account to another person.
5. Contributions, transfers & disbursements
The Service allows post-tax contributions to your HSP account from linked bank accounts (via ACH), one-time bank transfers, and one-time card contributions for gifts (via Stripe). Contributors you invite may also fund your account.
Funds in an HSP account are intended to be used for a qualifying home purchase and related expenses. You may not freely withdraw funds to arbitrary external accounts; disbursements are controlled and supported only for specific purposes (e.g., closing-related payments, refunds, account closure). We may suspend, limit, or refuse any contribution, transfer, or disbursement we reasonably believe to be fraudulent, unauthorized, prohibited, or noncompliant with applicable law.
6. Fees
Fees applicable to your account are disclosed within the Service prior to account opening and as fees change. Current fees include a monthly maintenance fee for beneficiary accounts, transfer fees from contributor accounts, third-party payment fees, and a closing fee at home purchase. Fees are debited automatically from your active account into a Six Pillar operating account at our sponsor bank. We may change fees from time to time with prior notice as required by law.
7. Electronic communications & consent
By using the Service, you consent to receive communications from us electronically, including by email and (where you have opted in) by SMS. You consent to receive legally required disclosures, notices, and agreements electronically. You may withdraw consent to receive electronic disclosures by contacting support@sixpillarfinancial.com; withdrawal may require us to close your account.

8. Electronic fund transfers (Regulation E)
Electronic fund transfers to and from your HSP account are subject to the federal Electronic Fund Transfer Act and Regulation E. If you believe an electronic fund transfer on your account is unauthorized or incorrect, contact us at support@sixpillarfinancial.com as soon as possible. We will investigate and respond in accordance with Regulation E. Specific error-resolution procedures, liability limits, and timing requirements will be provided in your account disclosures.
9. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent, or unauthorized purpose.
- Use the Service to launder money, finance terrorism, evade sanctions, or violate any law.
- Provide false, inaccurate, or misleading information.
- Attempt to access another user's account.
- Reverse-engineer, scrape, or interfere with the Service or its security.
- Use the Service to harass, abuse, or harm another person.
10. Third-party services
The Service relies on third-party providers, including Plaid Inc. (identity verification, bank account linking, sanctions monitoring), Twilio (SMS), Amazon Web Services (hosting and email delivery), Stripe (card payments), and Jack Henry & Associates and VictorFi (banking infrastructure). Your use of these features may be subject to those providers' own terms, including Plaid's end user privacy policy at https://plaid.com/legal/#end-user-privacy-policy.
11. Account closure
You may close your HSP account by contacting us. Account closure following a qualifying home purchase may involve refunds to linked contributors and other account-closing steps described within the Service. We may suspend or close your account at any time, with or without notice, if we reasonably believe doing so is necessary to comply with law, prevent fraud or abuse, or protect Six Pillar, our sponsor bank, or other users. Closed accounts are placed in a suspended state and retained as required by law; certain records cannot be deleted.
12. Intellectual property
The Service, including all software, content, design, and trademarks, is owned by Six Pillar Financial, Inc. or its licensors and is protected by U.S. and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
13. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including any warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation, except to the extent such warranties cannot be disclaimed under applicable law. Nothing in the Service constitutes legal, tax, financial, or investment advice.
14. Limitation of liability
To the maximum extent permitted by law, in no event will Six Pillar or its directors, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with the Service or these Terms. Our aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total fees you paid to us in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnification
You agree to defend, indemnify, and hold harmless Six Pillar, our sponsor bank, and our respective affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with (a) your access to or use of the Service, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.
16. Dispute resolution & governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Federal law also applies where it governs. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts. The arbitration and class-waiver provisions that will apply at general availability will be added to a future version of these Terms.
17. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms at legal.sixpillarfinancial.com/terms.html and update the effective date. Material changes will be communicated to active users. Your continued use of the Service after an update constitutes acceptance of the revised Terms.
